La resoluci\u00f3n de la magistrada Susana Polo llega despu\u00e9s de que el juez de la Audiencia Nacional Manuel Garc\u00eda Castell\u00f3n archivase su causa sobre la plataforma independentista por un error de forma que le obligaba a retrotraer la instrucci\u00f3n hasta el a\u00f1o 2021.<\/p>\n<p class=\"paragraph\" data-mrf-recirculation=\"Links inline\">En un auto dictado este martes, la juez explica que toma esta decisi\u00f3n tras la resoluci\u00f3n de la Sala de lo Penal de la Audiencia Nacional, que ayer\u00a0<a href=\"https:\/\/www.infobae.com\/espana\/2024\/07\/09\/todas-las-consecuencias-del-error-del-juez-garcia-castellon-impulsor-y-verdugo-del-caso-tsunami-tres-anos-a-la-basura-y-una-victoria-para-puigdemont\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-mrf-link=\"https:\/\/www.infobae.com\/espana\/2024\/07\/09\/todas-las-consecuencias-del-error-del-juez-garcia-castellon-impulsor-y-verdugo-del-caso-tsunami-tres-anos-a-la-basura-y-una-victoria-para-puigdemont\/\"><b>declar\u00f3 inv\u00e1lidas las actuaciones<\/b><\/a>\u00a0acordadas por el titular del Juzgado Central de Instrucci\u00f3n n\u00famero 6 de la Audiencia Nacional en los \u00faltimos tres a\u00f1os por haber dictado\u00a0<b>fuera de plazo la pr\u00f3rroga<\/b> de la causa.<\/p>\n<p class=\"paragraph\" data-mrf-recirculation=\"Links inline\">La magistrada se\u00f1ala que antes del 29 de julio de 2021, que es el l\u00edmite temporal para haber realizado diligencias de investigaci\u00f3n seg\u00fan lo acordado por la\u00a0<a href=\"https:\/\/www.infobae.com\/tag\/audiencia-nacional\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-mrf-link=\"https:\/\/www.infobae.com\/tag\/audiencia-nacional\/\"><b>Audiencia Nacional<\/b><\/a>, \u201cno se llev\u00f3 a efecto ninguna investigaci\u00f3n de la causa determinante de la participaci\u00f3n de los investigados en los hechos que se le imputa\u201d. De hecho, la imputaci\u00f3n en el Supremo de Puigdemont y Wagensberg, ambos en condici\u00f3n de aforados, no se produjo hasta finales de 2023, cuando se estaba negociando la\u00a0<b>ley de amnist\u00eda<\/b>.<\/p>\n<p class=\"paragraph\" data-mrf-recirculation=\"Links inline\">Adem\u00e1s, Polo entiende que el archivo de Garc\u00eda Castell\u00f3n \u201csin duda afecta a la resoluci\u00f3n que debe ser tomada en la presente causa especial\u201d, puesto que el juez acord\u00f3 diligencias de investigaci\u00f3n contra Puigdemont y Wagensberg para poco despu\u00e9s elevar una exposici\u00f3n razonada al Supremo\u00a0<b>\u201cde forma extempor\u00e1nea\u201d<\/b>. As\u00ed las cosas, la instructora del alto tribunal acuerda el \u201csobreseimiento provisional y archivo de la actuaciones\u201d sobre los dos aforados.<\/p>\n<div class=\"headline-wrapper\">\n<h2 class=\"header headline-class-h2\">La decisi\u00f3n de Garc\u00eda Castell\u00f3n<\/h2>\n<\/div>\n<p class=\"paragraph\" data-mrf-recirculation=\"Links inline\">En su auto de este martes, el juez Manuel Garc\u00eda Castell\u00f3n expuso que con la decisi\u00f3n de la Sala de lo Penal lo que proced\u00eda es el archivo de la causa, dado que<b>\u00a0no se hab\u00eda tomado declaraci\u00f3n<\/b>\u00a0a las personas investigadas en esta causa en fechas anteriores al l\u00edmite temporal de julio de 2021 que fij\u00f3 la Sala, quien pese a su resoluci\u00f3n dijo al instructor que con \u201clibertad de criterio y ajust\u00e1ndose a las diligencias practicadas dentro del periodo de instrucci\u00f3n que concluy\u00f3 el 29 de julio de 2021\u2033, resolviera lo que considerase \u201coportuno\u201d.<\/p>\n<div class=\"headline-wrapper\">\n<h2 class=\"header headline-class-h2\">La reacci\u00f3n de Puigdemont<\/h2>\n<\/div>\n<p class=\"paragraph\" data-mrf-recirculation=\"Links inline\">Antes de conocer la decisi\u00f3n de la magistrada, Puigdemont ha asegurado que la investigaci\u00f3n del caso Tsunami Democr\u00e0tic \u201cs\u00f3lo buscaba embarrar durante a\u00f1os, intimidar a personas clave y ensuciar la narrativa sobre el independentismo\u201d.<\/p>\n<p class=\"paragraph\" data-mrf-recirculation=\"Links inline\">\u201cEl ataque a la reputaci\u00f3n y el sufrimiento que ha representado todo esto para muchas personas y sus familias no lo revierte nadie.
